Mexico Supreme Court rules on wind energy fees and community conflict laws

The Supreme Court of Justice of the Nation (SCJN) has invalidated a municipal fee in Villa de Arriaga, San Luis Potosí, regarding wind energy generator construction licenses. The court ruled that the 620 UMA fee established in the 2026 Revenue Law encroached upon federal jurisdiction over the electrical sector. The decision, reached with seven votes in favor and two against, determined that while municipalities manage land use, specific charges targeting wind energy generation fall under federal authority.

In a separate ruling, the SCJN determined that the Mexican Congress is not constitutionally required to create differentiated regulations for every specific type of community conflict within the General Law of Alternative Dispute Resolution Mechanisms. The court addressed a challenge claiming the law should include specific sections for indigenous, Afro-Mexican, school, and neighborhood disputes. The justices concluded that while mediation and conciliation are essential to justice, the mandate to issue a general law does not obligate the legislature to create exclusive regulations for every distinct social or community context.
