Mexico's Supreme Court takes up María Elena Ríos acid attack case

Mexico’s Supreme Court of Justice of the Nation (SCJN) has attracted the case of Oaxacan saxophonist María Elena Ríos to review several appeals filed by the accused in her 2019 acid attack. The decision was reached by a 7-1 vote during a plenary session.

The court will not rule on the guilt of the defendants but will instead analyze a procedural controversy. Specifically, the SCJN will determine if a substitute judge has the legal authority to nullify an acquittal and order a new oral trial after the original judge, who presided over the evidence, was suspended.

The case involves Juan Antonio Vera Carrizal, a former local deputy and businessman alleged to be the intellectual author of the attack, among others. The legal debate centers on the principle of immediacy, which requires that the judge delivering the sentence must be the same one who directly observed the evidence and hearings.
