Mexico Supreme Court to review Swiss evidence in Lozoya-Odebrecht case
Mexico’s Supreme Court of Justice of the Nation (SCJN) has agreed to review an appeal from the Attorney General's Office (FGR) regarding the criminal case against former Pemex director Emilio Lozoya Austin. The court approved the request with a six-to-two vote.
The central issue is whether evidence provided by Swiss authorities in connection with the Odebrecht bribery scandal can be reinstated in the legal proceedings. A federal judge had previously excluded this evidence during an intermediate hearing in June 2024.
The FGR contends that the information was transmitted in accordance with the Criminal Legal Assistance Treaty with Switzerland, which allows documents and statements from the requested state's central authority to be accepted as evidence without additional formalities. The SCJN must now determine if these materials require further judicial control or if they can be admitted directly through the international cooperation mechanism.
