Mexico Supreme Court to review visitation rights for parents accused of femicide
The Supreme Court of Justice of the Nation (SCJN) in Mexico will analyze whether adolescent children can visit parents accused of femicide in prison. The court has attracted an amparo case involving the murder of a woman whose husband is the alleged perpetrator. In this specific instance, one of the couple's children is a witness to the crime within the criminal proceedings.
Minister Giovanni Figueroa Mejía noted that the case will help establish criteria for determining the conditions under which adolescents can interact with parents in penitentiary centers. The ruling aims to define protection measures to ensure such visits do not pose a risk to the integrity of the minors. Minister Arístides Guerrero García added that the matter holds significant legal and social relevance, as it could set a precedent for future cases involving the femicide of a mother and the visitation rights of her children.
The resolution will prioritize the best interests of the child, considering the specific circumstances and potential emotional effects of the visitation. The matter will be assigned to a minister to draft a project for discussion and resolution by the Plenary.
