Mexico Supreme Court upholds Michoacán independent candidate restrictions
The Supreme Court of Justice of the Nation (SCJN) has upheld an electoral reform in Michoacán that restricts independent candidates from conducting joint campaigns. The ruling, which dismissed a challenge by Movimiento Ciudadano, establishes that independent candidacies are inherently individual and unipersonal by constitutional design.
Under the validated reform, independent candidates are prohibited from sharing common platforms, propaganda, images, slogans, or coordinated promotional strategies. The Court reasoned that allowing such collective action would allow groups to function as political parties without meeting the legal obligations and responsibilities required of formal political institutions.
While the Court affirmed the restrictions on joint campaigning, it invalidated certain provisions of the Michoacán Electoral Code that allowed authorities to impose sanctions based on subjective perceptions of voter sentiment. The Court ruled that any electoral sanctions must be based on clear, objective, and verifiable conduct rather than the mere perception that candidates are acting as a single bloc.
