Mexico blocks permanent export of Frida Kahlo painting, Supreme Court to decide

Mexico’s Secretariat of Culture, led by Claudia Curiel de Icaza, has halted the definitive export of a Frida Kahlo work, invoking the institute’s mandate to protect national artistic heritage. The move follows a legal challenge that prompted the Supreme Court of Justice of the Nation to reassess whether the 1984 presidential decree declaring all Kahlo works a “monument artistic” can restrict permanent overseas sales.

Curiel distinguished this case from the private Gelman collection, which, while protected, is scheduled to travel abroad and return to Mexico. She emphasized that the INBAL’s role is to ensure that works classified as national patrimony remain preserved, stating the institute “has protected and denied that it could be a definitive export.” The court’s upcoming ruling could affect other private collections of Kahlo’s art, such as the Gelman and Dolores Olmedo holdings.
