European Commission reviews MiCA crypto regulation

The European Commission is conducting a review of the Markets in Crypto-Assets (MiCA) regulation to determine its effectiveness as digital asset markets evolve. The review process, which included public consultations, aims to balance market protection with the need to maintain innovation within the European Union. A formal report is expected to be presented to the European Parliament and the Council by June 30, 2027.

The European Securities and Markets Authority (ESMA) has submitted recommendations to the Commission to enhance the framework. ESMA’s proposals include stricter rules for crypto-asset marketing by influencers, increased transparency regarding costs, and new requirements for staking, lending, and borrowing services. Additionally, ESMA has called for strengthened supervisory powers to combat online fraud, unauthorized services, and non-compliant stablecoins.

While MiCA provides a comprehensive framework for many service providers, it currently excludes fully decentralized finance (DeFi) protocols that operate without an identifiable intermediary. The European Banking Authority (EBA) has also suggested reviewing the treatment of risks in multi-issuer stablecoin schemes and crypto-asset lending.

In the private sector, Spanish institutional custodian Cecabank is utilizing the MiCA passporting process to expand its regulated crypto-asset custody services into Luxembourg, Ireland, and Portugal.
