Michael Saylor proposes ‘bill of digital rights’ for digital assets

Michael Saylor, Executive Chairman of MicroStrategy, has proposed a ‘bill of digital rights’ to support the growing digital economy and artificial intelligence era. The framework advocates for the fundamental rights of individuals and corporations to create, issue, custody, transfer, and use digital assets.

Saylor argues that the current regulatory environment, specifically the Basel framework's 1,250% risk weight for certain crypto assets, creates barriers to institutional adoption. He proposes that commercial banks should be authorized to provide Bitcoin custody services and offer loans using Bitcoin as collateral. He suggests distinguishing between customer custody, Bitcoin-backed lending, and proprietary bank positions to allow for clearer regulation.

To facilitate everyday use, Saylor calls for a ‘de minimis’ tax exemption for routine digital asset payments. He argues that current tax requirements, which necessitate calculating capital gains for small purchases, create an administrative burden that discourages widespread adoption. Additionally, he advocates for the reuse of identity verification across service providers to reduce costs and friction in the financial system. His ultimate goal is to enable 10 million new companies to access capital through digital asset issuance, potentially driving a digital asset industry valued at $100 trillion.
