Michoacán Legislature approves reforms to simplify property lien cancellations

The 76th Legislature of Michoacán has unanimously approved reforms to simplify the cancellation of property liens and reduce bureaucratic burdens. The changes involve amending the Civil Code and the Law of Registry and Cadastral Functions.

The new measures aim to modernize the Public Registry of Property by establishing a more flexible procedure to purge obsolete entries. Specifically, the reform introduces an administrative cancellation process for expired or prescribed liens, particularly those where 20 years have passed since the expiration of the guaranteed credit or the term for execution.

To ensure legal certainty in real estate transactions, the administrative cancellation can only be requested by individuals with legitimate legal interest and must be supported by documentation proving the procedural status of the originating legal action.
