Migrant displacement and legal battles intensify in South Africa

Zimbabwean nationals displaced by anti-migrant operations in South Africa’s Limpopo province are currently camping outside the Mankweng Police Station near Polokwane. The group is appealing to the Zimbabwean government to provide transport and funding to return them and their belongings home. Truckloads of goods belonging to individuals repatriated in July remain stranded at the site, as drivers await payment from the Zimbabwean government to cover fuel and toll costs.

In a related legal development, the Johannesburg High Court is facing a surge of urgent applications from undocumented foreign nationals fighting deportation. Following a Constitutional Court ruling that asylum seekers cannot be deported without proper access to the asylum system, Judge Mandlenkosi Motha addressed the influx of cases involving Ethiopian, Congolese, and Nigerian nationals.

Judge Motha criticized “catch and release” procedures, stating that releasing undocumented individuals only for them to be re-arrested is “the height of folly” and can lead to corruption and exploitation. He ordered the Department of Home Affairs to send officials to the Lindela Repatriation Centre or transport detainees to refugee reception offices to ensure necessary asylum processes are completed.
