The plaintiffs are seeking to have their former US sanctions declared illegal. They argue that although the sanctions were formally lifted in October 2025, they continue to suffer lasting financial damage, including blocked assets and exclusion from the global financial system because commercial databases still flag them as sanctioned individuals.

A central component of the legal argument involves the ‘Autopen’ affair. The legal team contends that the sanctions are invalid because they were allegedly signed using a mechanical device by aides rather than by President Biden personally. The lawsuit requests that the court order the permanent removal of their records from official and commercial databases and seeks nominal damages of 1 dollar for each plaintiff for alleged constitutional violations.

A court hearing is scheduled for September 8, 2026, when a new judge, Jeffrey Kuntz, is expected to consider the US government's response to the request to dismiss the case.
