Ministry of Home Affairs clarifies contract signing authority

The Ministry of Home Affairs has provided clarification regarding the authority to sign employment contracts within public service units under Decree No. 235/2026/ND-CP.

According to the Ministry, Clause 2, Article 7 of the Decree stipulates that the signing of contracts for professional, technical, and support positions is decided by the head of the public service unit. However, Clause 3, Article 7 allows the head of a public service unit to either sign contracts directly or delegate the authority to sign contracts for service-related tasks—those not included in the official list of civil servant positions—to the heads of subordinate units.

The Ministry advised the inquiring individual to consult their specific workplace for further guidance and resolution within their jurisdiction.
