Minnesota prosecutors charge James O’Keefe and Cam Higby with felonies

Hennepin County Attorney Mary Moriarty announced felony charges of unlawful voting and identity theft against conservative activists James O’Keefe and Cam Higby on Wednesday, October 28, 2026. The charges stem from an undercover stunt conducted during the August 11 primary election in Minneapolis.

Prosecutors allege the men misrepresented their identities by providing election judges with the names of registered voters without their knowledge or permission. The activists, who wore costumes and used fake accents, were attempting to test Minnesota’s “vouching” system, which allows a registered voter to attest to the identity and residency of up to eight other individuals.

While the men did not cast actual ballots or sign the required voter oaths, authorities contend that initiating the process using the names of real voters—including some who were deceased—constitutes a crime. Higby stated the investigation was intended to expose vulnerabilities in the state’s voting system. Each felony count carries a potential penalty of up to five years in prison and a $10,000 fine.
