Mohamed father and son seek to halt extradition proceedings in Guyana

Nazar Mohamed and his son, Azruddin Mohamed, have returned to the Court of Appeal of Guyana to request a stay on extradition proceedings. The pair, who are sanctioned and indicted by the United States, are challenging the constitutionality of the Fugitive Offenders (Amendment) Act.

The application follows a February High Court ruling by Acting Chief Justice Navindra Singh, which found that Section 8(3)(B) of the Act was inconsistent with the Constitution of Guyana, though other challenged provisions were upheld. The Mohameds' legal counsel, Senior Counsel Roysdale Forde, argued that interim protection is necessary to ensure their liberty is not affected before the substantive constitutional appeal is fully determined.

Previous attempts to halt the proceedings through the Magistrates’ Courts, the High Court, and the Court of Appeal were unsuccessful. Additionally, the Caribbean Court of Justice (CCJ) previously discharged an interim stay after dismissing their appeal in July.
