Montana clinic owner ordered to pay $2.4 million for Medicaid fraud

The Montana Department of Justice has uncovered a Medicaid fraud scheme totaling nearly $2.4 million, the largest in the state's Medicaid Fraud Control Unit history. A judge ordered Kevin Patrick Maxwell, the former owner of Providence Mental Health Services (PMH) in Bozeman, to pay $2,391,277.55 for defrauding taxpayers.

Investigations revealed that between January 2022 and November 2024, PMH billed Medicaid for mental health sessions provided by interns and non-licensed staff who were not authorized to bill the program. Additionally, the facility was not a licensed mental health center for a portion of that period, which is a requirement for billing Medicaid.

Maxwell closed PMH in June 2025 and subsequently moved to Texas. The case was filed as a civil complaint for violations of the Montana False Claims Act.
