Montenegro Constitutional Court Aims to Resolve 2025 Appeals by Year‑End

The Constitutional Court of Montenegro disclosed a timetable to conclude all constitutional complaints filed in 2025 by 31 December. The court currently faces 789 pending appeals, having already cleared every 2024 case – a first since the court’s jurisdiction began in 2007. Milan Vukčević, head of the constitutional complaints division, emphasized that cases will be processed in order of receipt, with priority given to prison‑related matters (25 cases) and that more complex matters may require additional time.

The Human Rights Association (HRA) criticised President Jakov Milatović for issuing a decree on 1 July 2026 that established a new Judicial Council before the previous council’s mandate expired on 11 July. HRA argues the move reflects selective interpretation of the constitution, undermines legal certainty and exceeds the president’s authority, which, they say, is limited to declaratory acts and does not extend to influencing the council’s composition.
