The Constitutional Court of Montenegro has concluded a public hearing regarding the constitutionality of laws that mandate vaccination for children to attend public and private preschool institutions. The court is reviewing Articles 41 and 42 of the Law on Protection of the Population from Infectious Diseases, which require proof of mandatory immunization unless a permanent medical contraindication exists.

During the hearing, various stakeholders presented conflicting views. Health officials and epidemiologists warned of declining immunization rates, noting that UNICEF reports only 23 percent of children born in 2024 received their first MMR dose. They argued that preventive measures are necessary to avoid outbreaks. Conversely, NGOs such as 'Roditelji' and 'Alternativa Crna Gora' questioned the proportionality and effectiveness of the measure, arguing that it restricts children's access to education and social development.

The Constitutional Court is expected to deliver its final decision on September 24.
