Montenegro updates laws for foreign workers and residency

Montenegro is implementing legislative changes to align its regulations regarding the entry, stay, and employment of foreign nationals with European Union directives. A key component of this process is the introduction of a new Law on the Employment and Self-Employment of Foreigners.

Under the proposed system, the Ministry of Internal Affairs will continue to issue unified temporary residence and work permits. However, a new requirement will mandate obtaining prior consent from the Employment Agency of Montenegro before a permit can be granted. While the Ministry of Labour, Employment and Social Dialogue maintains this is necessary to prevent illegal migration and labor, the Employers' Union has expressed concerns that this additional step could create new business barriers and slow down hiring processes.

Additionally, amendments to the Law on Foreigners aim to combat labor exploitation. The new rules introduce the concept of a ‘victim of illegal employment,’ providing legal protections and potential temporary residency for foreign nationals—including minors or adults working in exploitative conditions—who cooperate with authorities against employers. Employers found hiring undocumented workers face fines ranging from 1,000 to 10,000 euros and potential business bans.
