Munich Administrative Court overturns residential building permit

The Munich Administrative Court has overturned a building permit for a residential project after a neighbor successfully challenged the construction's proximity to the property line. The project involved the renovation of a listed farmhouse and the replacement of its economic section with a 19-meter-long residential building.

The court ruled that the building violated distance regulations intended to protect neighbors. Although a permit existed from 1960 for the previous structure, the court found that the actual building had been constructed much closer to the boundary than the original plans indicated, meaning it could not be used as a legal basis for the new construction. Additionally, the court determined that monument protection did not justify the deviation from spacing requirements, as the specific section being replaced was not itself protected.
