Munich court overturns building permit following neighbor dispute

The Administrative Court of Munich has overturned a building permit for a residential project following a successful legal challenge by a neighbor. The dispute involved the renovation of a listed farmhouse and the replacement of its former agricultural section with new living space.

The new construction, which spanned approximately 19 meters in length, was built with a distance of only about one meter from the neighboring property boundary. This violated public law regulations regarding required distance areas, which typically mandate a distance of approximately three meters.

The court ruled that the permit was unlawful because the previous agricultural building from 1960 did not justify a legal exception. Although a permit existed for the old structure, its actual location was significantly closer to the boundary than indicated in its original site plan, meaning it could not be treated as a legally established building for the purpose of granting construction easements. Additionally, the court found that monument protection for the farmhouse did not justify the violation, as the specific agricultural section being replaced was not itself protected.
