Munich court rejects neighbor's claim to trim overhanging trees
A Munich district court has dismissed a lawsuit filed by neighbors seeking to trim overhanging branches and roots from a 12-meter-high hedge and spruce tree. The plaintiffs had previously hired a professional company to cut back the branches themselves and subsequently sued the tree owners to prevent future overgrowth.
The court ruled that the claim to remove the original overhanging vegetation had expired due to the statute of limitations. Additionally, the Munich Tree Protection Ordinance played a role in the decision, as the court found that trimming the trees would have altered their characteristic appearance, which is protected under local regulations.
