Oktoberfest tent allocation faces legal challenge in Munich

A legal dispute regarding the allocation of festival tents at the Munich Oktoberfest is heading to a main hearing at the Bavarian Higher Administrative Court on September 11. The conflict centers on whether the city's selection process complies with European procurement law.

Gastronomer Alexander Egger, who unsuccessfully sought a large tent, has challenged the current criteria. He argues for a more competitive process under European law. In response, the Association of Munich Oktoberfest Hosts has defended the city's methods, asserting that the 13 established criteria—which include factors like tradition, local presence, and experience—are transparent, publicly viewable, and have been upheld in previous court rulings.

The hosts emphasize that protecting the festival's unique character and traditions is a legitimate reason for the current system, which provides certain advantages to long-standing providers. While the court decision will not impact the immediate start of the upcoming festival on September 19, it carries significant implications for future tent assignments and the competitive landscape of the event.
