Oktoberfest tent allocations face legal challenge in Bavarian court

The Bavarian Supreme State Court is reviewing the legality of the Munich city administration's allocation process for large beer tents at the Oktoberfest. The dispute centers on whether the current system, which typically favors local hosts through a points-based evaluation, complies with European procurement laws.

Plaintiff Alexander Egger is seeking a ruling that would require these lucrative festival spaces to be tendered across the European Union. He has specifically requested a review of the allocation for the Schottenhamel and Paulaner tents. A successful challenge could fundamentally alter the rules for tent assignments at Germany's largest folk festival.

In a related matter, Egger is also pursuing legal action regarding the allocation of space at the 'Oidn Wiesn' (the traditional part of the festival) through the Munich Administrative Court.
