Municipality of Andria wins tax dispute against ARCA Puglia
The Municipality of Andria has secured a significant legal victory against ARCA Puglia regarding the payment of the 2020 IMU tax on social housing located within the municipal territory. The second-instance Tax Court of Justice overturned a previous ruling that had initially favored ARCA Puglia.
The court clarified a key legal principle: properties owned by the former IACP (now ARCA Puglia) do not automatically qualify for IMU tax exemptions as 'social housing.' The exemption applies only when the entity uses the property directly; it does not apply when the property generates income through lease payments.
This decision follows previous successful legal actions by the municipality concerning TASI taxes for 2018 and 2019, as well as IMU taxes for 2018 and 2019. Mirko Malcangi, the Councilor for Sustainability, Economic Programming, Budget, and Taxes, stated that the administration is working to verify the budgetary impact and will proceed with legal tools to ensure the recovery of these resources.
