Nahir Galarza seeks review of perpetual prison conviction

Nahir Galarza, convicted of the 2017 murder of Fernando Pastorizzo and sentenced to perpetual imprisonment, has filed a formal request for a sentence review before the Sala Penal N° 1 of the Superior Tribunal de Justicia de Entre Ríos. The petition, presented by her new lawyer Eduardo Gerard, invokes article 527 of the Entre Ríos Criminal Procedure Code, which permits exceptional revision of final sentences when exceptional circumstances arise.

The defense challenges two key aspects of the original trial. First, it argues that the forensic analysis of Galarza’s mobile phone, conducted by police expert Gabriela Laiño, was invalid and improperly influenced the finding of a marital‑like relationship between Galarza and the victim – a factor that allowed the court to apply the aggravated homicide by relationship provision. Second, it contends that the relationship did not meet the statutory legal requirements for such an aggravating factor and that the trial failed to consider a gender‑perspective.

The original conviction, handed down in July 2018, was upheld by the Argentine Supreme Court in July 2024, which dismissed the previous extraordinary appeal. The current request asks the provincial tribunal to re‑examine both the forensic evidence and the legal interpretation that led to the perpetual‑prison sentence.
