Nairobi court invalidates Parklands building approvals

The Environment and Land Court in Nairobi has declared all development approvals issued in the Parklands area after October 15, 2026, to be null and void. The ruling follows the Nairobi City County Government’s failure to meet court-ordered deadlines to establish a County Physical and Land Use Planning Consultative Forum and to gazette local development plans.

The court found that the county’s handling of developments since August 2019 violated residents’ constitutional rights to human dignity and a healthy environment. Consequently, the judgment stipulates that any approvals issued after the missed deadlines—including building works, demolitions, land-use changes, lease extensions, subdivisions, easements, and certificates of occupation—are automatically invalid.

The Parklands Residents Association noted that the county failed to fulfill the requirements within the previously mandated six-month and 12-month windows. This ruling leaves property owners and developers in the area facing significant legal uncertainty regarding various property-related permissions.
