Namibia Competition Commission updates merger thresholds and launches tourism probe
The Namibia Competition Commission (NaCC) has implemented several regulatory changes and launched a new investigation into the country's tourism sector.
To reduce the regulatory burden on smaller transactions, the NaCC has increased merger notification thresholds. The threshold for combined assets or turnover has risen from N$30 million to N$60 million, while the target company threshold has increased from N$15 million to N$30 million. NaCC Chief Executive Vitalis Ndalikokule stated these adjustments reflect Namibia’s economic growth since the previous thresholds were set in 2017. The commission is also simplifying its filing fee structure into three categories: small, intermediate, and large mergers.
Separately, the NaCC has formally initiated an investigation into alleged anti-competitive practices within Namibia’s tourism concessions and joint ventures. Following a complaint regarding agreements between various conservancies and a private operator, the commission is examining potential restrictions on market access, operating limitations, and unclear geographical boundaries. The investigation aims to ensure compliance with national policies intended to balance economic empowerment with environmental sustainability.
