Namibia High Court orders NAC to allow Puma Energy to resume airport fuelling

The Windhoek High Court has clarified that the Namibia Airports Company (NAC) must allow Puma Energy Namibia to resume its aviation fuelling business at Eros and Andimba Toivo ya Toivo airports.

The ruling follows a dispute regarding a previous court order from April 2026. While NAC had restored Puma’s physical possession of specific premises and facilities, the company argued that the order did not mandate the resumption of fuelling operations. Acting Judge James Devittie ruled that the original order encompassed both the corporeal possession of the premises and the incorporeal aspect of conducting the refuelling business.

Although the court found that NAC had not complied with the initial order, it declined to find the company in contempt. The judge noted that NAC had acted on legal advice suggesting that restoring physical possession constituted compliance, meaning Puma failed to prove that NAC acted with wilful bad faith.
