Namibia High Court voids antibiotic supply rejection

The Namibia High Court has set aside a decision by the Namibia Medicines Regulatory Council (NMRC) to reject an application by Econo Investments (Pty) Ltd to supply 140,000 vials of an injectable antibiotic.

Judge Orben Sibeya issued the order on 15 October 2026, following a settlement reached between Econo Investments and the respondents. The legal dispute concerned the supply of Ceftriaxone Sodium for Injection BP 1g, a medicine manufactured by China-based NCPC Hebei Huamin Pharmaceutical. The vials were intended for the Ministry of Health and Social Services’ Central Medical Stores under a specific state tender.

Econo Investments had challenged the regulator's rejection, arguing that the NMRC was required to comply with a previous decision made by its own appeal committee regarding the application. The court order reviewed and set aside the NMRC’s rejection dated 15 September 2026 and made no order regarding legal costs.
