Namibian High Court oversees property settlement and N$97M debt dispute
The Arandis Town Council has agreed to pay businessman Simon Shaninga N$95,292.81 to settle a High Court dispute regarding a contested property lease. The settlement includes a refund of N$74,375.40 paid by Shaninga in December 2024, along with N$20,917.41 in legal costs. The dispute arose from an attempt to transfer lease rights for Erf 748 from Hans Pieter Somaeb to Shaninga.
In a separate legal matter, the High Court has ordered that trustees of Herman Nekomba’s insolvent estate replace him in a multimillion-dollar litigation involving The Spar Group Limited. Spar is seeking N$97,215,114.41 in outstanding debt from Nekomba and several linked companies. The court ruling allows the claim to proceed against the legally authorized liquidators following the insolvency and liquidation of the involved parties.
