National Audiovisual Council introduces new rules for content creators

The National Audiovisual Council (CNA) is introducing a new notification procedure for digital content creators operating on platforms such as YouTube, Facebook, Instagram, and TikTok. Scheduled to take effect on September 27, 2026, the regulation is outlined in CNA Decision no. 116/2026.

To be classified as an on-demand audiovisual media service subject to notification, a creator must meet several cumulative criteria. These include having editorial responsibility over content, a primary objective of providing informative, educational, or entertainment video material, and conducting commercial activities.

Specific thresholds for mandatory notification include having at least 100,000 followers or subscribers, which can be an aggregate total across multiple platforms. Additionally, the creator must have published at least 24 audiovisual materials in the last 12 months and must derive financial gain, products, services, or other benefits from their content.

The process is a notification procedure rather than a licensing requirement. Creators must submit a form and required documentation, such as an identity document and a unique declaration registered with ANAF regarding social media income. Once submitted, the CNA will issue an advisory notice attesting to the registration of the service.
