Navarra court upholds 10-year sentence for sexual assault via age deception

The High Court of Justice of Navarra (TSJN) has upheld a 10-year prison sentence for a 20-year-old man convicted of sexual assault against a minor in the Pamplona region.

The court ruled that the defendant used deception to gain the victim's trust, falsely claiming to be 15 years old on Instagram to establish a relationship with the 15-year-old girl. The court determined that the relationship lacked free consent due to this deception and noted the defendant's position of superiority. The ruling also addressed additional charges related to cyber harassment and the possession of pornographic material.
