Nayarit pension reform validated by Mexico's Supreme Court

The Supreme Court of Justice of the Nation (SCJN) has ruled on the constitutionality of Nayarit's pension reform, specifically the Law of the Dignified Retirement Savings Fund for Workers of the State of Nayarit. While the Court validated the state's authority to create a new social security regime and the increase of required contribution years from 30 to 35 to access a full pension, it invalidated several provisions.

The Court ruled that the state exceeded its powers by attempting to extend this public regime to private sector employees and independent workers. Additionally, the SCJN identified legislative omissions and ordered the Nayarit Congress to implement corrections by December 2026.

Key protections established by the ruling include mandatory worker representation in the Fund's governing bodies, the establishment of a pension update mechanism, and the removal of unconstitutional restrictions on holding office. The legal challenges were brought forward by the National Human Rights Commission (CNDH) and the Commission for the Defense of Human Rights for the State of Nayarit (CDDHN).
