NCAA sues Ohio Governor Mike DeWine over eligibility executive order

The NCAA has filed a federal lawsuit against Ohio Governor Mike DeWine following his issuance of an executive order that allows Ohio colleges and universities to expand eligibility for certain student-athletes. The order provides public and private institutions the option to allow athletes from the high school class of 2022 to compete for a fifth year, despite new NCAA guidelines that exclude those who have already completed four seasons.

NCAA President Charlie Baker described the lawsuit as an “extraordinary step” intended to prevent an unfair competitive advantage for Ohio schools. The NCAA argues the order attempts to compel institutions to ignore established rules, which could undermine the level playing field essential to collegiate sports. The lawsuit, filed in the U.S. District Court for the Southern District of Ohio, cites constitutional concerns, including First Amendment violations.

Governor DeWine defended the move as a matter of fairness, stating he wants Ohio student-athletes to have the same opportunities as those in other states. Meanwhile, the Ohio Supreme Court has intervened to determine the legality of the executive order, pausing a previous appeals court ruling that had declared the 2022 graduates ineligible. The court has requested legal briefs from both parties by next Monday.
