Delhi High Court dismisses Neha Bora's plea against police peace bond

The Delhi High Court has dismissed a petition filed by Neha Bora, president of the All India Students’ Association (AISA), challenging a notice from a Special Executive Magistrate (SEM) to furnish a ₹10,000 peace bond. The notice was issued following Bora's detention on October 16 during a protest in Delhi demanding the resignation of Chief Election Commissioner Gyanesh Kumar.

Justice Subramonium Prasad ruled that the notice was not based on mere hearsay and that the SEM had sufficient material, including general diary entries and existing FIRs, to initiate preventive proceedings under the Bharatiya Nagarik Suraksha Sanhita (BNSS). The court noted that the area where the protest occurred is a major commercial hub, making law and order concerns relevant.

While dismissing the plea, the court directed the SEM to provide Bora with all relevant materials used in the inquiry and to ensure that the principles of natural justice are followed. The judge also instructed the magistrate to consider the specific implications of Section 135 of the BNSS regarding when such bonds should be required during an inquiry.

Bora has maintained her refusal to sign the bond, arguing that such measures are being “weaponised” to curb the democratic right to dissent and protest.
