Netflix sued for $105 million over loss of unreleased Nicolas Cage film 'Fortitude
Swiss producer Simon Afram and his company Op‑Fortitude have filed a $105 million lawsuit in a California federal court against Netflix. The complaint says Netflix failed to protect an unencrypted digital cinema package (DCP) of the unreleased World War II film "Fortitude", starring Nicolas Cage, Ben Kingsley and others. The film cost about $45 million to make and required seven years of production. According to the suit, an associate delivered the DCP to Netflix’s Los Angeles office in mid‑June 2026. Nine days later Netflix confirmed, via an email from head of film acquisitions Sean Berney, that several hard‑drives, including the one containing the master copy, had been stolen from its office desks. Netflix argues the copy was unencrypted, that it follows industry‑standard security practices, and denies liability. No unauthorized copy of the film has been found online, and the case could set a precedent for distributor responsibility and affect the film’s marketability.
