Netherlands evaluates rental regulations and short-stay limits

The Dutch government is proposing to limit short-stay rentals to 30 days to improve rent protection and legal certainty for students and migrant workers. However, the Advisory Board for Regulatory Burden (ATR) has warned that the impact of this limit on housing flexibility and the availability of temporary accommodation is not yet sufficiently understood.

The ATR noted that it remains unclear whether alternative contract forms will serve as adequate substitutes for current short-stay arrangements or if the measure will unintentionally reduce the supply of temporary housing. Additionally, the transition rights for existing short-stay arrangements have not been clearly defined.

Separately, Minister Boekholt-O’Sullivan stated that municipalities possess sufficient tools to combat undesirable landlord behavior under the Good Landlordship Act. An evaluation of this act is currently underway, with results expected to be shared with the House of Representatives this autumn. The Minister emphasized that local authorities can intervene against issues such as intimidation, excessive rents, and improper service charges through enforcement, fines, or rental permits.
