Netherlands issues penalties following two fatal construction accidents
Two separate legal rulings in the Netherlands have addressed fatal workplace accidents in the construction sector involving negligence and safety violations.
A contractor from Noord-Holland has agreed to pay a 30,000 euro settlement following a fatal accident in Delft in June 2023. A 45-year-old employee was crushed between a truck and a mini-excavator when the truck rolled backward due to a brake defect. The Public Prosecution Service (OM) determined that the company failed to adequately map risks and lacked sufficient supervision regarding collision hazards.
In a separate case, a crane operator from Berg en Dal received a 120-hour community service sentence, half of which is suspended, for causing a death in Ravenstein in April 2024. The victim fell from a roof after being struck by a steel plate that spun uncontrollably due to a gust of wind. The court ruled the operator was negligent for failing to calculate wind limits or monitor weather warnings, citing his decision to rely on experience rather than safety protocols as ‘worrying’.
