New Hampshire courts deem cryptocurrency marital property in divorces

New Hampshire applies its equitable distribution law (RSA 458:16‑a) to treat cryptocurrency and other digital assets as marital property. Courts look at whether the asset was acquired during the marriage, not its form, meaning Bitcoin, Ethereum, NFTs and similar tokens are subject to division. The digital nature of these assets creates challenges for identification, valuation and disclosure, especially given price volatility and the possibility of hidden wallets.

Divorce practitioners are advised to conduct early forensic examinations of digital holdings, obtain independent valuations, and consider the timing of valuation dates.
