New Jersey Enacts Ban on AI-Driven Personalized Pricing
Governor Mikie Sherrill signed the Fair Price Protection Act on July 23, 2024, after it cleared both legislative chambers on June 30. The law prohibits retailers from using personal data—such as browsing behavior, location information or purchase history—to set individualized prices for the same grocery or essential item. It blocks AI‑driven “surveillance pricing” that could charge different shoppers different amounts for identical products.
The measure was sponsored by state Senators Joe Cryan and Joe Lagana, and Assembly members Rosaura Bagolie, Annette Quijano and Chigozie Onyema. With the new rule, New Jersey becomes the third state, after Maryland and Connecticut, to restrict such pricing practices, while similar bills are being debated in California, New York, Massachusetts and Illinois. Supporters say the law protects low‑income consumers and addresses privacy concerns, whereas critics warn it may limit retailers’ pricing flexibility and raise broader data‑privacy questions.
