New Jersey Enacts FAIR Act to Regulate Rent-Setting Algorithms

Governor Mikie Sherrill signed the Forbidding the Algorithmic Inflation of Rent (FAIR) Act in late July, targeting the use of rent‑setting software by landlords. The law requires revenue‑management platforms to disclose pricing methods and prohibits algorithms that could artificially inflate rents, aiming to improve housing affordability in a state where rents are more than 20% above the national average.

The measure follows a Department of Justice antitrust case against RealPage, a property‑management software firm, which settled in November 2024 with a prohibition on using non‑public data in its pricing algorithms. New Jersey’s Attorney General Jennifer Davenport highlighted the need to prevent landlord collusion through shared algorithmic pricing tools.
