New Jersey petitions Supreme Court over prediction market regulation

New Jersey has petitioned the U.S. Supreme Court to determine whether individual states possess the authority to regulate sports betting conducted through prediction markets. The legal dispute centers on whether these transactions should be classified as “swaps,” which would place them under the exclusive jurisdiction of the U.S. Commodity Futures Trading Commission (CFTC), or as traditional gambling subject to state gaming laws.

New Jersey Attorney General Jennifer Davenport is seeking to overturn a decision by the 3rd U.S. Circuit Court of Appeals that favored Kalshi, a prediction market platform valued at $22 billion. The appellate court previously ruled that the federal Commodity Exchange Act likely preempted state laws. This request follows a conflicting ruling from a different federal appeals court, which determined that Nevada gaming regulators could still require Kalshi to hold a state gaming license.

The Supreme Court's decision will have significant implications for the rapidly growing prediction markets industry, potentially deciding whether companies must adhere to state-level consumer protections and licensing requirements or follow a standardized federal regulatory framework.
