Cornell University gang rape case: NY appoints special prosecutor FAST-MOVING

New York Governor Kathy Hochul has appointed Attorney General Letitia James as a special prosecutor to investigate an alleged gang rape at Cornell University's Chi Phi fraternity in October 2024. The decision follows revelations that the initial investigation by the Cornell University Police Department and the Tompkins County District Attorney’s office may have been flawed.

Hochul expressed deep concern that the victim, identified as Jane Doe, was failed by institutions meant to protect her. Specifically, she noted that the local district attorney declined to prosecute without interviewing the accuser and that police reports allegedly omitted her explicit claims of being raped. Tompkins County District Attorney Matthew Van Houten, who had previously closed the case, has since reopened the investigation and stated he will cooperate with the Attorney General’s office.

In response to the case, Cornell University has committed to an independent external review of its handling of the allegations. Additionally, Governor Hochul has signaled her intent to work with the state legislature to reform New York’s sexual assault laws, aiming to close a loophole that currently makes it difficult to prosecute cases where a victim has voluntarily consumed alcohol or drugs.
