New York City approves year-round outdoor dining
New York City Mayor Zohran Mamdani has signed legislation making outdoor dining on city roadways a permanent, year-round option. The new law, Intro. 0655, was sponsored by City Council Member Lincoln Restler.
The measure reverses a previous rule that required restaurants to dismantle roadway dining setups between November 30 and March 31. By allowing these structures to remain in place, the law aims to reduce the significant financial burden on small businesses that previously had to pay tens of thousands of dollars annually to remove and store equipment during the winter months.
Under the new regulations, the New York City Department of Transportation will establish rules to allow restaurants to winterize their setups, providing protection against snow and low temperatures. To mitigate neighborhood disturbances, the law requires outdoor dining establishments to close by 11 p.m. during the winter season, an earlier cutoff than previous regulations. Additionally, businesses must ensure their outdoor spaces remain clear of trash, graffiti, and vermin.
