New York City Council restores year-round outdoor dining

The New York City Council has passed a series of bills to restore year-round outdoor dining across the five boroughs, reversing a 2023 decision that limited roadside setups to a seasonal schedule from April to November.

The new legislation allows restaurants to keep roadside and sidewalk setups open 365 days a year. Key provisions include allowing dining structures to be enclosed with vertical coverings during winter months and permitting business owners to pay outdoor dining fees in quarterly installments rather than a single annual lump sum.

Council Speaker Julie Menin noted that the move aims to expand revenue potential for restaurants and reduce the burden on businesses that lack the space to store equipment during the off-season. While the measures provide relief to merchants, the laws maintain strict penalties for owners who allow dining structures to become run-down or abandoned.
