New York City faces lawsuits over proposed city-owned grocery stores

New York City Mayor Zohran Mamdani is moving forward with a plan to establish five city-owned grocery stores across the five boroughs to improve food affordability. The initiative involves allocating approximately $70 million in capital funds to develop sites, with the city covering major overhead costs such as rent, construction, and property taxes. While private operators will manage daily operations, the plan mandates that a core basket of essential staples be sold at a 30 percent discount.

The initiative has faced legal challenges from the Multicultural Business Coalition. Two lawsuits filed in Manhattan State Supreme Court argue that the plan creates an uneven playing field by using taxpayer subsidies and waived costs that private competitors cannot match. One lawsuit alleges the plan discriminates against Latino and Asian business owners, potentially violating state civil rights laws and equal protection guarantees. The second lawsuit challenges the city’s legal authority to operate retail stores in this manner. The first store is slated to open in Hunts Point, Bronx, by late 2027.
