New York City grocers sue to block municipal grocery store initiative

The Multicultural Business Coalition has filed two lawsuits in New York State Supreme Court to block Mayor Zohran Mamdani’s plan to open five city-run grocery stores. The coalition, representing hundreds of immigrant-owned bodegas and grocery stores, argues that the initiative violates civil rights and the Equal Protection Clause of the New York State Constitution.

The plaintiffs contend that the municipal stores will sell essential items, such as meat, seafood, and produce, at rates approximately 30 percent below market value. They argue this creates an unfair competitive disadvantage that could drive minority-owned small businesses out of operation. One lawsuit seeks to block the stores unless the city conducts economic impact studies, claiming there is currently “no existing evidence” that such analyses were performed.

Mayor Mamdani defended the initiative as a response to the cost-of-living crisis, noting that grocery prices have risen significantly in recent years. The administration maintains that existing subsidized models, such as the Essex Street Market in Manhattan and Moore Street Market in Brooklyn, have not negatively impacted surrounding local businesses.
