New York City real estate faces rent freeze and brokerage lawsuits

New York City's real estate landscape is facing legal challenges regarding both government policy and brokerage practices. A judge has granted Mayor Zohran Mamdani’s request to move a lawsuit challenging a rent freeze from Staten Island to Manhattan. The case, brought by landlords, argues that the Rent Guidelines Board failed to comply with its statutory mandate. While Staten Island has been a frequent venue for legal challenges to the Mayor's policies, the court ruled that because the decision was made by the board in Manhattan, the case should be heard there.

Separately, a class action lawsuit has been filed against the brokerage firm Compass. The plaintiffs allege that Compass is using its significant market share to create a “fake supply shock” by delisting thousands of rental units from free digital platforms like Zillow. The lawsuit claims this practice artificially inflates rents and forces consumers to use brokers to find available housing. The plaintiffs argue that Compass’s control over a vast majority of Manhattan rental listings allows it to manipulate pricing and increase broker fees. In response to these delisting practices, Zillow has announced new standards to prevent such private listings from appearing on its sites.
