New York City second-home tax faces legal challenges

New York City is facing legal challenges regarding a new tax on second homes, a policy introduced by Mayor Zohran Mamdani's administration. The tax targets luxury properties, such as pied-à-terres, as part of an effort to increase contributions from the city's wealthiest residents.

In recent court proceedings, attorneys for homeowners argued that the administration mishandled the rollout. Specifically, legal representatives claimed that thousands of property owners were wrongly included in eligibility lists and received erroneous notices. Judge Wayne Ozzi has shown openness to these arguments following a previous temporary restraining order that briefly halted the tax on homes valued above $5 million.

The administration has extended the deadline for homeowners to file for exemptions to October 6. As of late August, the city had approved 3,655 exemption applications out of over 10,000 initiated. While the administration faces criticism over the implementation process, officials have acknowledged that certain petitioners will ultimately not be eligible for the tax.
