US Federal Judge invalidates visa suspension for 75 countries
A federal judge in New York has invalidated a Trump administration policy that suspended immigrant visa processing for citizens of 75 countries. U.S. District Judge Jeannette Vargas ruled that the measure, implemented in January, was “contrary to law and in excess of statutory authority.”
The policy, issued by Secretary of State Marco Rubio, aimed to prevent immigrants from potentially becoming a public charge by accessing U.S. social benefits. However, the court found that the policy mandated the refusal of visas based on nationality, which violates the Immigration and Nationality Act and a 1965 law prohibiting such discrimination.
Judge Vargas also noted that the policy undermined the authority of consular officers, who are legally tasked with making individual determinations regarding visa eligibility. The ruling vacates the policy and invalidates any visa denials that were based solely on this mandate. The legal challenge was brought by organizations including the Catholic Legal Immigration Network and African Communities Together, alongside several individuals affected by the suspension.
